INSURANCE COVERAGE/BAD FAITH LITIGATION
Most people don’t seem to have any idea what I’m talking about when I tell them I am a coverage attorney. However, if you ever have a vandalism, fire or water loss at your home or business but can’t get your insurer to pay all benefits due under your insurance policy, a coverage attorney who can evaluate you policy and circumstance and explain why your claim is covered may earn a spot as your new best friend. If you are an insurer, you most certainly know the benefits of astute coverage counsel who can advise you about your rights and duties under property and liability policies so as to avoid any implication of unreasonable conduct that may subject you to bad faith liability.
As counsel for major insurance companies, I have read hundreds of insurance policies and drafted as many coverage opinions to clients detailing the reasons they either have, or do not have, contractual duties to pay claims or defend lawsuits filed against insureds by third parties. I have also successfully defended and helped to resolve bad faith lawsuits in state and federal court, as well as contribution and subrogation actions between insurers.
My past clients also include individual property owners and small businesses who sought coverage for perils which turned their home life upside down, destroyed business personal property or interrupted the flow of business income. I have persuaded multiple insurers to reverse initial denials of coverage and agree to provide coverage without filing a lawsuit.
